General terms and conditions for trips with limousines with driver
§1 Contract accomplishment
1.1.
The contract will only be accomplished after complete agreement and mutual consent. Both contract parties act for the purpose of the other.
1.2.
The Usage Driving the booked limousine is governed by a service agreement (driver service and rented car service). That contract is deemed concluded only when signed and sent back by the hirer by proxy for all passengers and the full agreed amount has been received in advance within the agreed period on our account. Normally, that advance payment incl. the agreed bond should be booked at least 5 days before the date of order. There is no conveyance obligation; all passengers must in advance be registered. Carrying along pets is categorically not allowed!
1.3.
Cancellation of the contract The contract may be cancelled at any time by both parties.
In case of cancellation by the client the following advanced payments will be reimbursed: Cancellation until 2 days before date of order: 40 %, until 12 hours before date of order: 60%. The bond will be reimbursed in case of any cancellation to 100%. In case of cancellation by us, at maximum the already paid charges will be reimbursed. There are no claims for damages or further demands.
1.4.
Deposit of bond The bond will individually be determined by us and will immediately be transferred back after performance of order. The bond serves for the protection against damages by gross failure of conduct. It is normally 100,- to max. 500,- EUR.
The hirer must inform the passengers going with about the rules of conduct of these general terms and conditions, particularly about the handling of technical equipment and the smoking ban (see also item 2-4).
1.5.
Adequate advance The executing company may in case of new clients and in case of orders of extensive volume demand an adequate advance. That will be agreed separately and in written. Breaches of our general terms and conditions with consequence of damage result in the retention of the bond.
§2 Conduct inside the limousine
For all passengers apply during the complete time of driving the German road traffic regulations (StVO), particularly the obligation of fastening the seat belt.2.1.
The instructions of the driver must always be followed; the driver has responsibility for safe performance of the trip and is always concerned about the well-being of his passengers. The limousines dispose of a sensitive and high-class interior equipment such as leather covers of the seats and carpeting as well as technical devices such as DVD player, VHS video recorder, CD changer, flat screens and lighting for reading.
2.2.
It is particularly prohibited for the passengers to open the doors while driving, to throw objects out of the vehicle and/or to have body parts sticking out of the vehicle or to scream out of it.
2.3.
If you want to operate the devices or parts of installations by yourself, a previous instruction by our staff is required. Playing your DVDs, CDs or videos will always be carried out for you by our driver. In case of need, you absolutely have to be instructed on the handling of the devices. The remote controls are at your disposal. Further handling requires some experience and must absolutely be agreed upon before. These notes are also included in your rental agreement.
§3 Smoking
Smoking is absolutely prohibited in the passenger compartment of the limousines and next to the driver as well as for the driver. If you want to smoke, a bond will be agreed amounting to 350.00 EUR for advanced payment which, in case of causing any gangrenous spots e.g. in the leather of the seats or the carpeting or in the velour of the carpet, serves as advance for any claims possibly asserted! There is no insurance against gangrenous spots or cigarette burns. The costs must completely be incurred by the causer plus loss of use during repair works! The bond will be transferred back after complete regulation of the damages by the causer/hirer.
§4 Bringing along meals and drinks
Bringing along foods is unwanted. Drinks may be brought along after previous agreement and may be consumed on board. Additional provisions for long-run renting with or without driver.§ 5. Long-run renting as from 1 week
In case of long-run renting as from 1 week (7 working days) additionally to the fare a bond amounting to 1/3 of the fare is due. Extension of the contract is possible after agreement and according to availability.5.1.
There is no car renting without driver.
5.2.
When booking the limousine with driver for long-run renting, the driver is daily for a max. of 12 hours, with a break of half an hour after each 6 hours of journey time at your disposal. Optionally we may deploy several drivers for one rental time. Arising expenses and costs for overnight stays are to be incurred appropriately by the hirer for the driver after agreement. Details are regulated in written in the rental agreement.
§ 6. General provisions and court of jurisdiction
The customer is fundamentally entitled to the limousine rented by him/her with the licence number and equipment indicated in the service agreement. In cases justified, however, we are entitled to place at the disposal another, similar limousine or to have the order carried out by partner companies. All required documents (e.g. passenger transport certificate and trade licence, proof of insurance) and licences are presented to you on demand by the driver deployed by us or by the partner company!Jurisdiction is Berlin.
